Buyers Club Terms Of Service

Welcome to the Buyers Club, a service provided by Cartzy LLC (referred to herein as the “Club”). By utilizing the services offered by the Club (the ”Services”), you agree, to the following conditions when you become a Member. Please read these conditions carefully.

Services

The Club will provide a curated list of products (each a “Product”) to you based on the Company’s analysis of the potential of each Product to generate sales and profits on variousretail sales channels (such as Amazon). The Company continuously updates these analyses within the Club’s database.

Pursuant to the Club’s policies, you may be restricted, at any given time, as to the amount of Products you may order. These policies are updated periodically.

After you purchase Products, the Club will use its warehouse and staff to coordinate all of the rest of the supply chain from getting the Products from the supplier to the warehouse to Amazon OR – the Products will remain in the warehouse to be fulfilled one at a time for other sales channels (like eBay).

Fees

You may choose to join the Club on a monthly or annual basis.

If you choose to join on an annual basis, the annual fee payable upfront is $1,980.

If you choose to join on a monthly basis, the fee is $249 payable at the beginning of the month.

The Club may change these fees at any time by posting such change on this site.

Membership and Refunds

If you choose to join on an annual basis, you may cancel your Membership for a full refund within thirty (30) of the commencement of your annual Membership period.

If you choose to join on a monthly basis, you must notify the Club that you are cancelling your membership no later than ten (10) days before the end of the current month in order to avoid being charged for the following month.

However, continued Membership in the Club is solely and exclusively at the discretion of the management of the Club. and management reserves the right to terminate any Membership at any time for any reason. Management, for example, may choose to terminate a Membership if there are excessive chargebacks. In such event, the Member will receive a refund for any partial period for which such Member has paid a fee. For example, if a Member has paid an annual fee and is terminated after 6 months, the Member will receive a refund of half the annual fee.

Change of Competitive Landscape and Other Business Risks:

• The Club analyzes each Products VERY close (within 2 days or so) to releasing them . HOWEVER, the competitive landscape is always changing. The ability to sell Products on certain channels, the number of sellers, the retail price etc.. are ALL moving targets. An event could happen that makes a product that once seemed great – not profitable any longer for certain or all sales channels.

• Inbound shipping costs to Amazon (for FBA sales channel) are often difficult to estimate and can, at times, turn products into non profitable ones.

• The Club could make mistakes (much of the process is human driven not programmatic). However, the Club does its best to give you ALL the tools and data to check the likely profitability of Products yourself. The club expects that you will do your own due diligence.

• The Club may encounter shipping delays for Products at any time.

• The Club is not responsible for any of these risks and issues. ALL responsibility lies with the member to analyze the data and to make their own final decisions.

Sales are Final

ALL purchases of inventory are final and non-refundable. There are no exception.

Accuracy of Information on this Site

Management does its best to ensure that information on this Site is complete, accurate and current. Despite best efforts, however, information on this Site may occasionally be inaccurate, incomplete or out of date. All specifications, Products, descriptions and prices of Products on the Site are subject to change at any time without notice.

The Club does not warrant the accuracy or completeness of the information, content or materials provided through this Site.

Discontinuation of Products or Services

The inclusion of any Products or Services on the Site at a particular time does not imply or warrant that these Products or Services will be available at any time. The Club reserves the right to discontinue any Product or Service at any time.

No Guaranteed Income

You are neither guaranteed a specific income nor assured any level of profit or success as the result of your purchase of a Membership in the Club. Generating meaningful income from Membership in the Club requires considerable time, effort, and commitment to the business.

Disclaimer of Liability

To the full extent permissible by law, the Club will not be liable for any damages of any kind arising from use of any Services described on this Site or from any information, content, materials or products which the Club provides to you, including, but not limited, to, direct, indirect, incidental, punitive and consequential damages.

This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay of operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action.
